Sarjapur electrician succumbs to injuries

 FIR has been filed against the flat owner.

A 19-year-old electrician, who fell from the fifth floor of an apartment in the Confident Apartment complex, took his last breath at 1:45 pm on April 01, 2023. He was being treated for his injuries at the Belenus Champion Hospital.

Vignesh, the elder brother of Vishal, the victim, said that his brother suffered injuries to his head, limbs and rib cage. “He had to be kept on life support for two days after which he finally succumbed to his injuries,” said Vignesh.

S.L.R Reddy, inspector, Bellandur Police station, confirmed that the victim had passed away and said that investigation is still going on.

Vishal, who worked as an electrician with Chroma AC Services, fell from the fifth floor of an apartment while he was fixing the Air Conditioner (AC). This incident took place on March, 30, 2023 at the Confident Apartment Complex on Sarjapur Road.

Vignesh had filed a complaint against the flat owner at the Bellandur Police Station. An initial First Information Report (FIR) under Indian Penal Code (IPC) Section 338 has been filed against Tejaswini, the owner of the flat.

Senior Criminal Lawyer, Mirza Faizen Assad, said that under the Section 338 of the Indian Penal Code (IPC), causing grievous hurt by act endangering life or personal safety of others is a criminal offence. The punishment for this offence is imprisonment for up to two years, or a fine, or both.

“If it is found that the owner and the contractor were aware of the risks involved in sending the worker without proper safety measures, and they wilfully neglected their duty of care, they may face a more severe punishment. The court may also order compensation to be paid to the family of the deceased worker,” said Assad

The AC that he fixed.

The property manager of the apartment, C.S Madan, said, “The house owner of the flat had asked Chroma AC Services for servicing and installation of her new AC. The boy who was sent by the contractor did not have any safety equipment with him and fell from the fifth floor.” He was rushed to the nearest hospital added Madan.

Nandesh Kumar,  the victim’s uncle said that the accident was the consequence of negligence on the part of the AC servicing contractor Saiyad Billal and the owner. He said,” The owner should have been more mindful about the worker, but instead she had called the service provider to file a complaint against the boy when he refused to install the AC fearing his safety.”
